General Terms and Conditions of Climate Show
General Conditions of Sale and participation of www.climateshow.ch, Vevey, Switzerland (for exhibitors, please refer to the General Conditions for Exhibitors)
The Vevey-based Climate Show (hereinafter referred to as “the organizer”, or “CS” or “Seller”) organizes exhibitions, which include workshops, training courses, conferences, events and others. Any interested person, company or organisation (hereinafter referred to as “participant”) may participate and request to speak or lead a workshop during the Show, or attend one or all of the conferences or events, subject to the provisions of these general terms and conditions. The organizer determines the categories of workshop providers and speakers, events, conferences and all general conditions, which may be modified at its initiative at any time. The rented space is the property of Palexpo and the Centre de Congrès 2m2c (hereinafter referred to as “the owner”). These general regulations apply to all participants in the Exhibition. The conditions for the organization of the Exhibition, and more particularly the opening and closing dates, the agenda, the venue and the price are set by the organizer and may be modified or cancelled at its initiative at any time.
The following provisions of the general terms and conditions also apply in relations with entrepreneurs, companies, businesses and private individuals in the following cases. Any interested person, company or organization (hereinafter referred to as the “buyer”) may purchase and order products and services such as tickets or otherwise by telephone, e-mail or via the Climat online store.
1 – Validity of our General Conditions of Sales
The Climate Show is a directory, exhibitions and listings of sustainable solutions and innovations for climate protection for professionals, investors and the public. The climate show is a marketplace that also allows participants to attend, facilitate or lead workshops, lectures, public debates, etc. In this case, the climate show acts solely as a host and facilitator. The workshop and events providers are neither the communication agents nor the commercial or legal representatives of the Climate Show.
1.2 Validity of the Present Terms
The present general terms and conditions of sale and participation have exclusive validity. They apply to all future orders for products or services if they are not renewed. Any conditions of the purchaser that are contrary to our general terms and conditions of business shall only be valid if we have expressly approved their validity in writing. The purchaser acknowledges our present general terms and conditions of sale and delivery, even if an order is executed without any express reservation in knowledge of the purchaser’s general terms and conditions of sale that are contrary to these terms and conditions.
2 – Sale and conclusion of the Contract
2.1 Validity of the Offers
The buyer may request a formal written offer by e-mail at any time before placing an order. Unless otherwise agreed, our offers are valid for 30 days from the date of issue. In order to be applicable, the number and conditions of the offer must be imperatively recalled at the time of the order (offer number in ref.).
Ticket and event prices are published in the CS e-Shop and can be modified, and it is indicated whether or not they include VAT . All prices listed in the CS Online Shop may not be current and are not legally binding. They may vary. Only the price confirmed directly by e-mail, in an offer or by acceptance of the online order will be valid.
2.3 Online Order
The Climate Show’s online e-Shop gives the buyer the possibility to purchase tickets for conferences and events online and to make payments using a certain type of credit card. When ordering a product online, the buyers’ order form becomes binding as soon as they click on the final order button in the last step of the online purchase process. The buyer will receive an automatic ticket sent by e-mail to his/her e-mail address. Admission to conferences or any other paid event is only possible for the buyer upon presentation of the admission ticket received.
2.4 Email Order
It is possible to order by e-mail by sending an e-mail to email@example.com. The non-binding order confirmation e-mail, which will be generated immediately and sent to the buyer, does not constitute an order confirmation at this stage. Only, after checking internaly, the CS will send an e-mail confirming acceptance of the order which will include the order number and the invoice of the order. Admission tickets for conferences and all paid events can not be accepted by email. These orders must go through the CS online e-Shop.
2.5 Payment when ordering by email
The term of payment is indicated on the invoice. Payment is due with the order, before delivery or can be made after delivery depending on the Offer.. Deductions, discounts or special offers are only permitted if they have been agreed in writing or expressly agreed on the invoice. The conditions and term of payment must be adhered to.
2.6 Payment default
In the event of late payment, the CS may suspend the execution of outstanding orders.
2.7 Payment when ordering online
Payment is due when ordering online and can be made using American Express, Master Card, Visa, JCB, Diners Club, Post Finance, Maestro and PayPal through a secure encrypted system. After the payment transaction, the buyer will receive a receipt or ticket of his payment. The CS reserves the right to exclude certain transactions without any justification. In addition, the SC reserves the right to cancel a transaction already accepted if it turns out that it was granted on the basis of inaccurate or misleading information, or if any other payment conditions have not been met.
3 – Return of tickets
Any return for exchange or other reason (s), must be the subject of a prior agreement between the CS Market and the buyer. Ordered in error are returned within a period of 7 days from the reception date.
4 – Intellectual property
All content present or made available a the Climate Show website is under international law of copyright, intellectual property, trademarks copyright and protection of databases. The compilation as well as the design of all the content of this website is the exclusive property of the Climate Show and is protected by the Swiss and international law of copyright, intellectual property and protection of the databases.
You might view this website and its contents, save and print a copy for your own information and research but you must not reproduce and transmit it for any commercial purposes. You may not distribute or exploit commercially or store in any other website or in other format, any of the content of this website including without limitation, the materials such as photographs, images, text, logos, buttons, graphics, digital downloads or any description part of this website.
You should not use robotic means for data extraction, or any other similar data collection or retrieval tools, to collect, retrieval and to reuse part or the whole content of this website, without our express and written agreement.
5 – Limitation of Liability
Article 472ss of the Swiss Code of Obligations does not apply in respect of the organiser or his auxiliaries, as the latter does not act as custodian, neither in respect of participants nor in respect of owners of goods or third parties. The organiser excludes all liability and right of recourse for the damage, theft, loss, official seizure and disappearance of the goods of the partipants. The organiser has no obligation to keep or protect participant goods, products, or other objects belonging to others. Any participant in the Show is liable for damages caused by their employees, agents or auxiliaries and in particular within the meaning of Article 101 of the Swiss Code of Obligations. The organiser disclaims any liability to the participant for the consequences of the environment, neighbourhood or conditions arising from their participation. It is the responsibility of the participant in the Show to be vigilant with respect to his materials and all property belonging to him.
6 – Private Information
In accordance with Swiss data protection law and EU personal data protection policy, the seller guarantees the protection of private data collected from the buyer during the purchasing transaction. The seller never trades or transmits any private buyer information to third parties unless we are obliged by law or we have to use them to protect our safety or rights. Private information collected from buyer Credit Cards are treated with high level of confidentiality during transactions and does not remain in our systems and servers after payment transactions are terminated.
7 – Special cases of cancellation and interruption of the Show
The organizer undertakes to cancel or postpone the Show if it finds an insufficient number of registrations or any other legitimate reason such as lockdown due to government restrictions, pandemics, etc. In this case, participants in conferences and paid events will receive a full refund of their registration fee. The participant accepts the present cancellation conditions and assumes the risks and costs related to the non-performance of the Show. In addition, in the event of unforeseeable force majeure during the week of the Show’s running, whether economic, political or natural, such as fire, flood, earthquake, disaster, accidental events, strikes, security risks, terrorist threats, storms, accidents, etc., the participant shall be liable for the costs of the Show, the organiser reserves the right to interrupt, postpone or cancel the Exhibition and to return the sums available to be shared between the participants in proportion to the sums paid by each of them after payment of the expenses incurred for the organisation of the Exhibition. The organizer cannot be held liable under any circumstances and the participant cannot claim any right under the termination of his contract, nor any compensation or indemnity for indirect prejudice.
8 – Validity of the Contract
These general terms and conditions are valid from 01.01.2021 and replace all previous directives and provisions.
9 – Applicable law and jurisdiction
Swiss law only is applicable and governs these present regulations. The invalidity of any provision of these present regulations shall not invalidate the entirety thereof. In case of dispute, the exclusive place of jurisdiction is the court of Vevey. Mandatory jurisdictions provided by law remain reserved. Only the French version of these present regulations shall prevail.
